OA 1573-2017 Rationalisation Teachers Station Seniority Count from Previous School. OA No 1573/2017. AP Tribunal has ordered an important judgement on Transfers issue for Rationalization affected teachers. APAT in its interim order instructed the CSE to award entitlement points for the services rendered by the rationalization affected teachers, in the previous and present places and allow the Teachers to participate in the ensuing transfer counseling and post them to the opted place as per their entitlement points and rules. Upon motion this day made into this Tribunal by MR, S, HARINATH REDDY. Advocate for the applicant and the Tribunal being of opinion that the records relating to and touching upon all the matter and contentions raised in the Memorandum of Original Application together with the decision therein, should be called for and perused

IT IS HEREBY ORDERED:

1. That you, the aforesaid Respondents do send for our use in Andhra Pradesh Administrative Tribunal at Hyderabad all and singular the said records and others will all things touching the same as fully and perfectly as they have been made by you and now remain in your custody or power together with the Rule Nisi Before the returnable within a period of 4 weeks.
2. The Original Application coming on today for orders as to admission and interim relief, upon perusing the application and the material papers filed therewith and upon hearing the arguments of Mrs. Harinath Reddy, Advocate for the applicant and of GP For School Education on behalf of Respndents, the Tribunal made the following:

OA No 1573/2017

1. The contention of the applicant is that she is working as Secondary Grade Teacher. While so, after working 6 years 2 months at MPP School, Etimonga, Nagaya Lanka Mandal, she participated in the transfer counselling held in the year 2015 and was posted to MPUP School, Nange Gadda, Nagaya Lanka Mandal as per her option and entitlement points. She is discharging her duties as such. In view of GO Ms No. 32 School Education Department dated 4.6.2017, the respondents are effecting transfers due to rationalization. In the result, the applicant will be shifted from that plce and she will be getting only 1 1/2 entitlement points. The applicant is entitled to continue up to 2023.  But due to the rationalization, she is loosing her entitlement points and she may not get a better place in th ensuing transfer counselling.
2. In view of the above facts and circumstances, the applicant has made out a pria facle case for granting exparte interim order. Balance of convenience lies in favour of the applicant. 
3. Admit issue notice to the respondents returnable in four weeks.

INTERIM ORDER

1. Pending disposal of the OA, the respondents are directed to consider the case of the applicant by awarding entitlement points for the services rendered in the previous and present places and allow her to participate in the ensuing transfer counselling and post her to her opted place as per her entitlement points and rules.
