- Pleased to direct the respondents to consider the case of the petitioners for appointment to the post of School Assistant Telugu/Kannada as per their seniority and eligibility in the ensuing counseling they posseseed higher qualification of P G in terms of Sub Clause 3 of Rule 5 of the statutory rules issued in G O Ms No 74 Dt 20092017 without reference to the G O Ms No 77 Dt 30 10 2019, or alternatively keep posts of School Assistant Telugu/Kannada vacant in respect of the petitioners concerned, pending disposal of the above W P
- Pleased to issue a Writ or direction more in the nature of Writ of Mandamus declare the impugned G O Ms No 77 dt 30 10 2019 in so far as not including the qualification of M A Telugu/ Kannada contrary to the statutory rules issued in G O Ms No 74 dt 20/09/2017 for promotion to the post of School Assistant Telugu/ Kannada while considering P G Degree MA Urdu and Pandits Trainings and single subject of M A English etc degrees obtained from Dr B R Ambedkar Open University for promotion and also in respect of direct recruitment vide G O Ms No 70 dt 05 11 2018 by not considering the petitioners though they possessed M A Telugu as per the Rules in the ensuing monthly counseling is as illegal arbitrary discriminatory and unjust and quash the impugned above G O in so far not including M A Telugu/ Kannada is concerned and consequently hold that the petitioners are entitled for promotion to be post of School Assistant Telugu/Kannada as they posseseed higher qualification of P G in terms of Sub Clause 3 of Rule 5 of the statutory rules issued in G O Ms No 74 dt 20092017 with all consequential from the date of their eligibility along with their counter parts like seniority pay fixation etc.
