ORDER:
In the G.O. first read above, Government have framed the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010 under the provisions of the Right of Children to Free and Compulsory Education Act, 2009 (Act No.35 of 2009) and published the Notification in an Extra-ordinary issue of the Andhra Pradesh Gazette dated.05.03.2011.·
2. In the reference 7th read above, Smt. T. Kalpalatha, Sri M.V. Ramachandra Reddy and Sri Chandrasekhar Reddy, Hon'ble MLCs, have represented to extend the validity period of recognition of Private Schools from 3 years to 10 years.
3. Government,. after careful examination of the matter, hereby decided to enhance the recognition period from (3) years to (8) Years, duly amending the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010, issued in G.O.Ms.No.20, School Education (PE-Progs.I) Department, dated:03.03.2011.
4. Accordingly, the following notification will be published in an Extra-Ordinary issue of the Andhra Pradesh Gazette dated :22.04.2023.
In exercise of the powers conferred by sub-section (1) of Section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Act No.35 of 2009), the Government of Andhra Pradesh hereby make the following· amendment to the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010 issued in G.O.Ms.No.20, School Education (PE-Progs. I) Department, dated:03.03.2011, as subsequently amended from time to time.

Government,. after careful examination of the matter, hereby decided to enhance the recognition period from (3) years to (8) Years, duly amending the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010, issued in G.O.Ms.No.20, School Education (PE-Progs.I) Department, dated:03.03.2011.

NOTIFICATION
In exercise of the powers conferred by sub-section (1) of Section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Act No.35 of 2009), the Government of Andhra Pradesh hereby make the following· amendment to the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010 issued in G.O.Ms.No.20, School Education (PE-Progs. I) Department, dated:03.03.2011, as subsequently amended from time to time.
AMENDMENTS
In the. said Rules,
(1) in sub rule (4) of Rule 14,
- (i) for the word "three years" wherever occurred, the word "eight years" shall be substituted".
- (ii) After clause (I), the following shall be added, namely:
- "(m) The School shall provide adequate accommodation (own or lease) for staff, pupil, equipment for laboratory, library and Computer room in respect of high schools, as prescribed by the Commissioner qf School Education / Government from time to time;
- (n) The School shall maintain Teacher Pupil Ratio as prescribed by the Commissioner of School Education / Government from time to time;
- (o) The School shall provide adequate accommodation for smooth conduct of classes. This shall be as per pupil and the area shall be calculated section wise ;
- (p) The School shall provide separate and adequate sanitary facilities for students for girls, boys, CwSN and also to the staff for men & women; _
- (q) The School shall provide adequate safe drinking water facilities to the students and staff ;
(s) The School shall provide Fire Extinguishers as prescribed in the National Building Code of India
art IV Fire Protection, 1997 and approved by Fire Service Department of the State. The school shall be exempted, if the building height is less than 06 meters and necessary arrangements i.e. sand buckets, water and any other items for the safety of the children to be made by the Management instead fire equipment;
(t) The School shall follow the rules and regulations prescribed by the Transport Authority regarding parking of school vehicles /maintenance of vehicles and ensure safety of children, and shall obtain fitness of the school vehicles from the Transport Authorities;
(u) The School shall produce Sanitary Certificate from the authorities concerned ;
(v) The school shall produce Structural Soundness Certificate of the school building/premises and - produce Occupancy Certificate from the authorities concerned ;
(w) The school shall produce No Objection Certificate from the Police Department (traffic) and as well as concerned Municipal Corporation or the Municipality in respect of all Municipalities / Municipal Corporation Areas. In respect of villages, No Objection Certificate shall be obtained from the local Gram Panchayat and No Objection Certificate from Police Department is not necessary;
(x) The school shall appoint qualified staff as per staffing pattern prescribed by competent authority from time to time ;
(t) The School shall follow the rules and regulations prescribed by the Transport Authority regarding parking of school vehicles /maintenance of vehicles and ensure safety of children, and shall obtain fitness of the school vehicles from the Transport Authorities;
(u) The School shall produce Sanitary Certificate from the authorities concerned ;
(v) The school shall produce Structural Soundness Certificate of the school building/premises and - produce Occupancy Certificate from the authorities concerned ;
(w) The school shall produce No Objection Certificate from the Police Department (traffic) and as well as concerned Municipal Corporation or the Municipality in respect of all Municipalities / Municipal Corporation Areas. In respect of villages, No Objection Certificate shall be obtained from the local Gram Panchayat and No Objection Certificate from Police Department is not necessary;
(x) The school shall appoint qualified staff as per staffing pattern prescribed by competent authority from time to time ;
(y) The Department reserves the right to introduce panel Inspection System for any school and its recommendation shall be binding on the Managements to take necessary corrective measures. Any school that continues to get less than 20% pass for 3 years consecutively in the public examination shall be liable for being closed ;
(z) Any school which has been closed down without prior permission of the competent authority or any school which has been closed down with the prior permission of the competent authority and has remained for more than five years, shall be treated as defunct school. If the defunct school is proposed to be reopened, it should be treated as a fresh proposal and all the conditions prescribed for establishment of new school shall be applicable to it ;
(aa) The educational agency shall carry out all the instructions issued by the Government and other competent departmental authorities, relating to making of admission of students, appointment of staff, other academic and administrative affairs in the interest of academic standards and smooth functioning of the institutions, from time to time ;
(ab) The Educational agency shall submit the Annual Administration Report in the prescribed proforma to the competent authority for very financial year by the 30th September at the latest. Such report shall be supported by the audited statement of accounts of the school duly audited by Chartered Accountant. Separate accounts shall be maintained for each school. Similarly, the educational agency, which is running more than one school, shall also submit such returns within the stipulated time to the competent authority ;
(ac) Apart from the above, the School shall fulfil all other conditions as prescribed by the Commissioner of School Education / Government from time to time.
(2) After sub rule (4), the following shall be added, namely:-
(z) Any school which has been closed down without prior permission of the competent authority or any school which has been closed down with the prior permission of the competent authority and has remained for more than five years, shall be treated as defunct school. If the defunct school is proposed to be reopened, it should be treated as a fresh proposal and all the conditions prescribed for establishment of new school shall be applicable to it ;
(aa) The educational agency shall carry out all the instructions issued by the Government and other competent departmental authorities, relating to making of admission of students, appointment of staff, other academic and administrative affairs in the interest of academic standards and smooth functioning of the institutions, from time to time ;

(2) After sub rule (4), the following shall be added, namely:-
"(5). The Commissioner of School Education shall create a portal where every year School Management to upload the self certified documents depicting the adherence to conditions and stipulations imposed at the time of sanctioning recognition."
