Sir.
I am directed to refer to your representation dated 02.08.2023 seeking clarification regarding prior to NCTE notification dated 23.08.2010 in the light of the Hon'ble High Court of Madras judgment requirement of Teacher Eligibility Test (TET) for promotion to the next level for the teachers appointed dated 02.06.2023 passed in Writ Appeal No. 313/2022 delineating thereunder that any teacher for future promotional prospects like promotion from secondary grade teacher to B.T. Assistant should acquire/clear TET irrespective of their dates of original appointment, failing which they will not be eligible for Promotion.

The matter has been examined and attention is invited to Clause/Para 4 of the National Council for teachers and Physical Education Teachers in Pre-primary, Primary, Upper Primary, Secondary, Senior Teacher Education (Determination of Minimum Qualifications for Persons to be recruited as Education Secondary or Intermediate Schools or Colleges) Regulations, 2014 notified on 12.11.2014, as amended from time to time stipulating therein the following manner of promotion of teachers from one level to the next level :
"Qualifications for Recruitment-
i. The qualifications for recruitment of teachers in any recognized school imparting Pre-primary. Primary, Upper Primary. -Secondary, Senior Secondary or Intermediate Schools or Colleges imparting senior secondary education shall be as given in the First and Second Schedule(s) annexed to these Regulations.
ii.For promotion of teachers the relevant minimum qualifications as specified in the First and Second Schedule(s) are applicable for consideration from one level to the next level."
3. Since, the minimum qualification laid down under RTE Act 2009 vide NCTE Notification dated 23.08.2010 (as amended time to time) wherein passing of Teacher Eligibility Test (TET) is a minimum qualification for a person to be eligible to be appointed as a teacher for Class I-VIII is an integral part of the NCTE Regulations 2014, therefore, the aforementioned regulation shall invariably applicable in case of promotion of teachers of classes I-VIII irrespective of their dates of original appointment.
