In continuation of this office proceedings dated 06.03.2024 in the 6th reference cited, it has been promoted several school assistants in Physical Education working in School Education Department have been promoted to the position of Junior Lecturer in Physical Education in Intermediate Education Department. They have been subsequently assigned to various locations within Zone-IV as per the posting orders issued by the Regional Joint Director of Intermediate Education, Kadapa, on 07.03.2024. It is crucial to acknowledge that these postings are subject to the outcome of the Orders in W.A. 572 of 2024.
The Hon’ble High court has issued the following orders dated 11.03.2024 in W.A.No. 572 of 2023 fled by the Government of Andhra Pradesh against the common orders made in W.P.No. 15311 of 2020 dated 22.07.2022 as follows:-
ORDER:
“1. Heard learned Government Pleader for Services-III and he learned counsel for the respondents.
2. On perusing the relief sought for in the writ petition and on perusing the relevant Government orders vide G.O.Ms.No. 25 School Education (IE) Department, dated 11.03.2016 and G.O.Ms.No. 26 School Education (IE) Department, dated 11.03.2016, it is seend that these G.Os relates to amendments to the Andhra Pradesh Intermediate Education Subordinate Service Rules’2002.
3. That being the undiputed fact as per the roster of Writ petitions wherein, challenges mounted to the authorization of statue rules and regulations are required to be heard by the Division Bench No.1, headed by The Hon’ble the Chief Justice.
4. In that view of the matter, the order of the learned Single Judge warrants interference.
5. Accordingly, the order impugned is set-aside and this matter is remitted back.
7. The writ petition stands restored and the same shall be placed before The Hon’ble the Chief Justice for consideration.
8. All consequential actions pursuant to the order of the writ petition stands annulled.
In view of the above, considering the aforementioned circumstances, the orders issued by this office vide Rc.No. SER.II-1/1464123/2021 dated 06.03.2024 are hereby cancelled, rendering consequential orders ineffective as well. The Regional Joint Director of Intermediate Education, Kadapa is instructed to annul the proceedings dated 07.03.2024 and ensure the immediate return of the petitioners to their parent institutions.
Receipt of these proceedings should be acknowledged.
